Terms of sale.

These Terms and Conditions (hereinafter, “T&C”) govern the online purchase service that allows the contracting of the products and/or services offered on the website www.planellesdonat.com (hereinafter Planelles Donat). Planelles Donat S.A. (hereinafter, Planelles Donat) is the owner of the Website and the supplier of the products and/or services marketed through it.

The contractual sales relationship involves the delivery, in exchange for a price expressly stated on this Website, of a specific product or service.

Purchasing through this website implies acceptance of the T&C in the version published at the time the Website is accessed, which implies that the User:

• Has read and understood what is set out in this document.
• Is a person with sufficient capacity to enter into contracts.
• Is responsible for complying with the obligations set out in the text.
• The User is responsible for the truthfulness of the data provided during the online purchase process.
• Likewise, if contracting on this Website requires the User to register, the User is fully responsible for the use and safekeeping of the username and password provided, and is liable for any actions carried out with them. The User must notify the provider, as soon as they become aware of it, of the loss, disclosure or unauthorised access by a third party to their private registered User area.

Planelles Donat reserves the right to modify these T&C, without this affecting products or services purchased through the Website prior to such modification.

In order to place an order, the User must be over 18 years of age.

In order to place the order, the User must provide all the data requested during the purchase process, which will be necessary to properly process the order.

All prices of the products or services on the Website include VAT and any other applicable taxes. Prices will always be expressed in euros (€).
For shipments to European Union countries, the VAT of the destination country will apply. For shipments outside the EU, 0% VAT will apply.

The prices shown for each product or service do not include shipping costs, shipping insurance or any other additional service to the product or service purchased, unless clearly stated otherwise. Any of these additional costs that apply will be announced to the User before the purchase is finalised.

The prices applicable to each product or service will be those published on the Website and applied directly by the purchasing process in its final stage. The User accepts that the economic valuation of some of the products or services offered may vary in real time. In any case, this will always be communicated prior to the formalisation of the sale.

The User undertakes to pay at the time of placing the order, and may pay using any of the payment methods specified on the Website.

Once payment has been made, the User will receive an order confirmation email, which will include a summary of the items purchased, the shipping method requested and the delivery address.

Planelles Donat will deliver orders to the address indicated by the User in the corresponding purchase form. Planelles Donat accepts no responsibility when delivery of orders cannot be carried out because the data provided by the User is false, inaccurate or incomplete, or for any other cause attributable to the User.

Planelles Donat will take all necessary measures to ensure that delivery can be made within the agreed period. Planelles Donat considers confirmation of payment, by any of the enabled systems, a necessary condition to be able to keep to the delivery times. Nevertheless, the times indicated to the User are an estimate and may vary for logistical reasons or force majeure.

Delivery times can be consulted in the purchase form, as well as in the FAQs section of the Website.

Delivery will be deemed to have been made from the moment Planelles Donat or the transport company hired by it makes the product available to the User.

The exchange and returns policy only applies to products purchased through our official website.

4.1 DEFECTIVE PRODUCT
If the product is defective, you must contact us by email at info@planellesdonat.com and send us a photo clearly showing the damage, and we will try to verify that the product is really defective.

4.2 INCORRECT ORDER
If you receive an order that does not match what you purchased, you must contact us by email at info@planellesdonat.com and send us an image showing everything you have received and the proof of payment and shipping. We will give you a solution once the contents have been verified.

If you have to send the product back, Planelles Donat will bear the shipping costs. As soon as it is verified that the order was incorrect, the refund or exchange will be made to the affected User.

The product must not have been used and must be in its original box with the packaging and any label that came with it.

4.3 EXCHANGES OR RETURNS OF THE ORDER
Planelles Donat does not accept exchanges or returns unless the product is defective or damaged, in which case you must contact us by email at info@planellesdonat.com.

The Website provides access to content on the Internet belonging to Planelles Donat to which the User may have access. The User assumes responsibility for the use of the portal. This responsibility extends to any registration that may be necessary to access certain services or content. In this registration the User will be responsible for providing truthful and lawful information.

The User undertakes to make appropriate use of the content and services that Planelles Donat offers through its Website and, by way of example but not limitation, not to use them to (i) engage in unlawful or illegal activities or activities contrary to good faith and public order, (ii) disseminate content or propaganda that is racist, xenophobic, illegally pornographic, that glorifies terrorism or that infringes human rights, (iii) cause damage to the physical and logical systems of Planelles Donat, its suppliers or third parties, or introduce or spread on the network computer viruses or any other physical or logical systems likely to cause the damage mentioned above, (iv) attempt to access and, where applicable, use the email accounts of other Users and modify or manipulate their messages.

Planelles Donat reserves the right to delete any comments and contributions that violate respect for human dignity, that are discriminatory, xenophobic, racist or pornographic, that harm young people or children, public order or security, or that, in its judgement, are not suitable for publication.

Planelles Donat complies with the guidelines of Organic Law 15/1999 of 13 December on the Protection of Personal Data, Royal Decree 1720/2007 of 21 December approving the Regulations implementing the Organic Law, and other regulations in force at any time, and ensures the correct use and processing of the User’s personal data. To this end, next to each form collecting personal data, in the services that the User may request from Planelles Donat, it will inform the User of the existence and acceptance of the specific conditions for the processing of their data in each case, stating who is responsible for the file created, the address of the controller, the possibility of exercising their rights of access, rectification, cancellation or objection, the purpose of the processing and any disclosures of data to third parties.

Likewise, Planelles Donat states that it complies with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce and will ask for the User’s consent to the processing of their email address for commercial purposes at each relevant time.

Planelles Donat, on its own or as an assignee, holds all the intellectual and industrial property rights of its website, as well as of the elements it contains (including, but not limited to, images, sound, audio, video, software or texts, trademarks or logos, colour combinations, structure and design, selection of materials used, and computer programs necessary for its operation, access and use), owned by Planelles Donat or by its licensors.

All rights reserved. Pursuant to Articles 8 and 32.1, second paragraph, of the Spanish Intellectual Property Law, the reproduction, distribution and public communication, including the making available to the public, of all or part of the contents of this website for commercial purposes, on any medium and by any technical means, without the mandatory authorisation of Planelles Donat, are expressly prohibited. The User undertakes to respect the Intellectual and Industrial Property rights owned by Planelles Donat. The User may view the elements of the portal and even print, copy and store them on the hard drive of their computer or on any other physical medium, provided that this is solely and exclusively for their personal and private use. The User must refrain from removing, altering, circumventing or tampering with any protection device or security system installed on the Planelles Donat pages.

Planelles Donat accepts no liability, under any circumstances, for damages of any kind that may be caused by, for example: errors or omissions in the contents, unavailability of the portal, or the transmission of viruses or malicious or harmful programs in the contents, despite having taken all the technological measures necessary to prevent it.

Planelles Donat reserves the right to make, without prior notice, any changes it considers appropriate to its portal, and may modify, remove or add both the contents and services provided through it and the way in which they are presented or located on its portal.

Planelles Donat may replace at any time the conditions presented here, and they will be duly published as they appear here. The validity of these conditions depends on their publication, and they will remain in force until they are modified by others duly published.

Should links or hyperlinks to other Internet sites be enabled on the Website, Planelles Donat will not exercise any control over those sites and contents. Under no circumstances will Planelles Donat assume any responsibility for the contents of any link belonging to a third-party website, nor will it guarantee the technical availability, quality, reliability, accuracy, breadth, truthfulness, validity or constitutionality of any material or information contained in any of these hyperlinks or other Internet sites. Likewise, the inclusion of these external connections does not imply any kind of association, merger or collaboration with the connected entities.

Planelles Donat will pursue any breach of these conditions, as well as any improper use of its portal, by taking all civil and criminal actions to which it may be entitled by law.

If any Clause of these T&C is declared void, the other Clauses will remain in force and will be interpreted taking into account the spirit of these T&C.

These conditions shall be governed by and construed in accordance with Spanish law in everything not expressly established. Planelles Donat and the User agree to submit any dispute that may arise from the provision of products or services to the Courts and Tribunals of the buyer’s place of residence, if the User is a final consumer, or, where applicable, to the Courts and Tribunals of Barcelona if the User is a company.
